Condition Details / Information Notes
The development hereby permitted shall begin not later than three years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following approved plans: i. Site Location Plan ref 23/502/DWG005 rev B, dated Jan 24 ii. Amended Proposed Block Plan ref 23/502/DWG004 rev D, submitted by email dated 2/5/24 iii. Proposed elevations ref 23/502/DWG003 rev A, dated Nov 23 iv. Proposed floorplans ref 23/502/DWG001 rev A, dated Nov 23 v. Proposed roof layout ref 23/502/DWG002 rev A, dated Nov 23 vi. Proposed material arrangement ref 23/502/DWG006 rev A, dated Nov 23 vii. Existing Sight Lines plan ref 23/502/DWG007 rev A, dated March 24 viii. Planning Statement submitted with the application ix. Supporting Statement dated 20/2/24 Reason: For the avoidance of doubt and in the interests of proper planning.
3. Prior to the commencement of development, details of a waste management strategy shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall set out the following: i. Details of a full clean-up and appropriate disposal of all litter and tipped waste within the redline boundary to be achieved prior to the first use of the development ii. Details of how waste will be managed during construction to ensure construction waste is not blown offsite and is disposed of appropriately iii. Details of appropriate safeguards on waste/litter for the operational cafe (i.e. ensuring waste disposal is suitability weather proof), together with regular checks and cleaning-up of litter within the red line boundary of the development. The approved scheme shall be adhered to for the lifetime of the café use Reason: In the interests of enhancing the protected landscape of the North Pennines Area of Outstanding Natural Beauty
4. Prior to the first use of the development, details of the package treatment plant for foul water disposal shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall then be implemented in full accordance with the approved details before the first use of the development, and shall be maintained as such thereafter. Reason: In the interests of sustainable drainage and to ensure no adverse impacts arise on the protected landscape of the North Pennines Area of Outstanding Natural Beauty.
5. Any additional temporary or permanent structures within the property shall be subject to a detailed planning permission during the operational period of the cafe. Any existing temporary structures on the premises shall be removed within 3 months of the first use of the site. Reason: In the interests of enhancing the protected landscape of the North Pennines Area of Outstanding Natural Beauty
6. The area of blanket bog which is located in close proximity to the south-western edge of the building must be avoided by all works. The limits of all works including tracking areas, compounds and laydown areas shall be established prior to construction using high visibility markers or similar. The markers shall be able to withstand high winds. Adherence to works limits shall be regularly checked during the construction process and reinstatement works implemented if they are breached. Reason: To protect priority habitat (blanket bog)
7. The site shall not promote or offer overnight stopping off within the building or elsewhere within the red line boundary of the application site. Reason: Overnight accommodation would require additional assessment for balancing nutrient pollution
8. There shall be no exterior lights on the building or the wider carpark. Reason: In the interests of avoiding light pollution and preserving the protected landscape of the North Pennines Area of Outstanding Natural Beauty
9. The development hereby approved shall operate only between the hours of 7am and 7pm. Reason: In the interests of preserving the protected landscape of the North Pennines Area of Outstanding Natural Beauty
10. The visibility splays as set out on plan ref 23/502/DWG007 rev A, dated March 24 shall be maintained clear of obstructions. Reason: In the interests of highway safety.
1. The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848. Further information is also available on the Coal Authority website at www.gov.uk/government/organisations/the-coal-authority
2. Any new advertisement boards to be erected will require the granting of separate Advertisement Consent
