Condition Details / Information Notes
The development hereby permitted shall begin not later than three years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan - 55 Shap Road, Kendal 1:1250 @ A4 Received 16 February 2024 Existing and Proposed Floor Plan KRC-1276-24-02-001 Received 16 February 2024 Reason: For the avoidance of doubt and in the interests of proper planning.
There shall be no more than two children cared for within the property at any one time. Reason: In the interests of residential amenity for the neighbouring residents.
The premises shall be used as a residential care home for young people (Under 18 years) only and for no other purpose (including any other purpose in Class C2 of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification). Reason: In the interests of residential amenity for the neighbouring residents.
Prior to the first occupation of the development, the approved parking layout shall be constructed, marked out and made available for use and shall be retained as such thereafter. The parking spaces shall be used solely for the benefit of the occupants and visitors of the development hereby approved and for no other purpose. Reason: In the interests of highway safety.
In the exercise of its judgement in determining the appropriate balance of considerations, the Local Planning Authority has acted positively and proactively in determining this application proposal, taking into account all material considerations. Material considerations include planning policies and any representations that may have been received preceding the determination to grant planning permission in accordance with the presumption in favour of sustainable development as set out in the National Planning Policy Framework. The Local Planning Authority is satisfied that its processes and practices are compatible with the Human Rights Act and the decisions of the European Court of Human Rights.
