Condition Details / Information Notes |
1. This Letter of Consent to undertake tree surgery or felling works to trees protected by a Tree Preservation Order and/or within a Conservation Area will expire after two years of the date of issue of the Letter. It is incumbent upon the applicant to ensure that further consent is obtained in the event of this Consent expiring without the works having been undertaken.
2. In taking the action specified in this Notice, special care should be taken to prevent harm or disturbance to wildlife. Under The Countryside and Wildlife Act and The Conservation Of Habitats and Species Regulations it is a criminal offence to disturb bats, birds and other wildlife therefore anyone working on trees should ensure the necessary checks are carried out fully before work commences to avoid the risk of prosecution.
3. It may be necessary to obtain the permission of the tree owner(s) or other parties before carrying out any consented work to trees as detailed in this notice and it is the applicant detailed above that is required to do this. The decision of the Council does not involve obtaining any such permission nor will it condone the use of the notice to obtain permission from the tree owner(s) or other parties.
4. Removal of dead wood and damaged branches from protected trees does not require the consent of the Council, however, if there is any doubt, always check with the Council.
5. If, when carrying out the work detailed in this Notice, significant defects in the tree(s) become apparent that were not obvious before work commenced, advice should be sought from the Council before work that is additional to that detailed in this Notice is carried out. It is always the responsibility of the person(s) carrying out and authorising the work to be able to prove that any additional work was necessary and failure to obtain the necessary consent may result in prosecution.
