Condition Details / Information Notes
Condition (1) The development hereby permitted shall begin not later than three years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Condition (2) The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan 20/14 01 as submitted to the Local Planning Authority on the 31st July 2020. Proposed Site Plan 20/14 02 as submitted to the Local Planning Authority on the 31st July 2020. Proposed access detail plan 20/14 03 Revision A as submitted to the Local Planning Authority on the 13th October 2020. Reason: For the avoidance of doubt and in the interests of proper planning.
Condition (3) The new hedgerow shall be planted within the first available planting season post construction as per the details submitted on the Proposed access detail plan 20/14 03 Revision A as submitted to the Local Planning Authority on the 13th October 2020. The hedge shall be maintained and retained thereafter. Any tree that dies, becomes severely damaged or diseased within five years of planting shall be replaced in the next planting season with a tree of similar size and species to those shown on plan number 20/14 03 Revision A. Reason: To ensure that the character of the area is not adversely affected in accordance with Policy CS1.1 of the South Lakeland Core Strategy. To safeguard the biodiversity net-gain in accordance with Policy DM4 of the Development Management Policies Development Plan Document.
Condition (4) Prior to being brought into use the visibility splays shall be created as shown on drawing number 20/14 - 03 Revision A as submitted to the Local Planning Authority on the 13th October 2020. Within the visibility splay the hedgerow shall be maintained to ensure clear visibility for agricultural vehicles at all times. Reason: In the interests of highway safety.
NOTE (1) NATURAL ENGLAND STANDARD INFORMATIVE: PROTECTED SPECIES: In accordance with the Wildlife and Countryside Act 1981 as amended by the Countryside and Rights of Way Act 2000, hedge removal should not take place between the months of March through to August. Should any protected species or evidence of protected species be found prior to or during the development, all works must stop immediately and an ecological consultant contacted for further advice before works can proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
