Condition Details / Information Notes
Condition (1) The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan, Drawing No. P-01, Received 21 August 2020 Proposed Floor Plans & Elevations, Drawing No.P-03, Received 21 August 2020, Reason: For the avoidance of doubt and in the interests of proper planning.
Condition (2) The materials to be used for the external surfaces of the development hereby approved shall be: Walls - Render & Opaque glazed screen (West Elevation) Walls - Random stone facing (North Elevation) The approved materials shall be retained thereafter, unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development is of a high quality design in accordance with Policy DM2 of the Development Management Policies Development Plan Document and Policy CS8.10 of the South Lakeland Core Strategy.
Condition (3) Notwithstanding the provisions of The Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order with or without modification) prior to the first occupation of the development hereby permitted, the balcony on the rear elevation of the dwelling shall be fitted with a screen 1.80 metres high on the western (side) elevation. The screen shall be permanently fixed and shall be permanently glazed with obscured glass to a degree sufficient to conceal or hide the features of all physical objects from view. The obscured glazed screen shall be retained and maintained in that condition at all times. Reason: To safeguard the amenity of the neighbouring residents in accordance with Policy DM2 of the Development Management Policies Development Plan Document and Policy CS8.10 of the South Lakeland Core Strategy.
In the exercise of its judgement in determining the appropriate balance of considerations, the Local Planning Authority has acted positively and proactively in determining this application proposal, taking into account all material considerations. Material considerations include planning policies and any representations that may have been received preceding the determination to grant planning permission in accordance with the presumption in favour of sustainable development as set out in the National Planning Policy Framework. The Local Planning Authority is satisfied that its processes and practices are compatible with the Human Rights Act and the decisions of the European Court of Human Rights.
