Condition Details / Information Notes
Condition (1) The development hereby permitted shall begin not later than three years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Condition (2) The development hereby permitted shall be carried out in accordance with the following approved plans: - Location Plan 1:1250 Dwg.No K434-01-LP - Proposed Plans 3 1:100 at A3 – Dwg.No K434-09-PP3 Rev C - Proposed Elevations 3 1:100 at A3 – Dwg.No K434-10-PE3 Rev C - Block Plan 1:500 – Dwg.No K434-02-BP Reason: For the avoidance of doubt and in the interests of proper planning.
Condition (3) The development hereby permitted shall be constructed entirely of the materials details of which are shown on plan Proposed Elevations 3 1:100 at A3 Dwg.No K434-10-PE3 Rev A. The approved materials shall be retained thereafter, unless otherwise approved in writing by the Local Planning Authority. Reason: To ensure the development is of a high quality design in accordance with Policy DM2 of the Development Management Policies Development Plan Document and Policy CS8.10 of the South Lakeland Core Strategy.
Condition (4) Prior to first occupation or use of the extension hereby permitted, the bird box and native plants detailed on Dwg.No K434-09-PP3 Rev C and Dwg.No K434-10-PE3 Rev C received by the Local Planning Authority shall be installed in full accordance approved details. The approved measures shall be retained and maintained within the development at all times thereafter, and replaced where neccessary. Any trees or flowers which are removed, die, become severely damaged or diseased within five years of their planting shall be replaced in the next planting season with trees / shrubs of similar size and species to those originally required to be planted unless the Local Planning Authority gives written consent to any variation. Reason: For the avoidance of doubt and to ensure a bio-diversity net gain in accordance with Policy DM4 of the Development Management Policies Development Plan Document and Policy CS8.4 of the South Lakeland Core Strategy
In the exercise of its judgement in determining the appropriate balance of considerations, the Local Planning Authority has acted positively and proactively in determining this application proposal, taking into account all material considerations. Material considerations include planning policies and any representations that may have been received preceding the determination to grant planning permission in accordance with the presumption in favour of sustainable development as set out in the National Planning Policy Framework. The Local Planning Authority is satisfied that its processes and practices are compatible with the Human Rights Act and the decisions of the European Court of Human Rights.
